JPNA Board requests removal of discriminatory language:

To Whom it May Concern:
As of today, the Jefferson Park Neighborhood Association has filed a revised version of the 1926 Conditions and Restrictions, also known as Conditions, Covenants, and Restrictions (CC&Rs) of Jefferson Park Addition, a neighborhood in the City of Tucson, County of Pima, and State of Arizona. This revision, through redaction, formally severs paragraph #3 of the previous version. No other change occurs.
In 1936, the Columbia Cattle Company, new owners of the Jefferson Park Addition property, filed an amendment to the 1926 CC&Rs that included building requirements, and extended the remaining 1926 CC&Rs in perpetuity to run with the property.
Revision of our original 1926 CC&Rs is necessary because the text of the severed paragraph was rendered invalid by two federal laws—the 1964 Civil Rights Act (78 Stat. 241) and the 1968 Fair Housing Act (82 Stat. 73)—as well as by the February 2025 vote of the residents of Jefferson Park at the February 26, 2025, Board meeting.
Accordingly, since at least 1964, paragraph #3 has been null and void, thus severable from our CC&Rs. The action we have taken formalizes that severability by, one, redacting the referenced paragraph to revise our CC&Rs and, two, filing those CC&Rs with the Pima County Recorder’s Office as the official version.
Authority for this action is found in Article IX of the February 2025 amended Jefferson Park Neighborhood Association Bylaws: It is the right and responsibility of the JPNA Board to review, amend or modify the CC&Rs as needed.
a. Specifically, any language that is racist, sexist, homophobic or discriminatory towards a specific group of persons in any way.
The remaining CC&Rs are unimpaired and in full force and effect.
As of this date, only the revised CC&Rs with paragraph #3 severed and redacted have any force and effect. All copies of the Jefferson Park CC&Rs containing the text of paragraph #3 unredacted, and, thus, not formally severed, are null and void.
